Cruickshank and Hemmingson offer a full range of legal services including:

Real Estate

Our real estate practice covers residential and commercial conveyancing and mortgages, farm sales and financing, condominium and land development.

We act for clients in all manner of real estate transactions, including options to purchase, easements, rights-of-way, building schemes, surface leases and in connection with mineral trusts.

Wills and Estates

Today more than ever, the importance of estate planning cannot be overemphasized. We are frequently advising clients and drafting documents ranging from fairly simple wills, powers of attorney and personal directives to more complex trusts, cohabitation and marriage agreements and tax planning initiatives where we often work closely with a client's accountant.

We pride ourselves on our expertise in administering estates effectively and obtaining Probate without unnecessary delay.

Where necessary, we will make applications to Court to address the validity of a Will and remuneration due to a personal representative.

Civil Litigation and Divorce

The firm's litigation files include many personal injury and divorce files as well as commercial and other litigation. We will also accept certain criminal law retainers, including impaired and other driving offences and defence of any Firearms Act charges.

Corporate and Commercial

We have represented thousands of individuals and businesses in their commercial transactions and on matters ranging from advice on the advantages of various business structures, incorporation, shareholder agreements and other documentation.

Our firm has long been active in handling financings, re-financing, agri-business matters, leases, corporate restructurings, mergers, tax rollovers as well as both purchases and sales of businesses.

Dependent Adult

Clients often find themselves in a situation where either or both of a Power of Attorney and Personal Directive do not exist or are defective. In these cases, we act for a person(s) – often a family member – who is willing to step in and assume responsibility for handling the finances and assets of the person who has lost mental competence or managing their health care and personal lives.

Our representation in all these cases is effective and considerate of the impact such circumstances can have on individuals and their families.

Impaired Driving, Firearms Act

Mssrs. Hemmingson and Ziakris will accept the defence of some impaired driving charges as well as any charges under the Firearms Act at an agreed flat fee.

Securities

Our securities files have included exempt offerings and limited partnerships with multi-jurisdictional issues.
